ARE IMMIGRANTS GETTING I-526 APPROVALS RIGHT NOW?

Yes! More investors in our Seattle Innovation Center project are getting their I-526 approvals this week. We continue to see approvals come in for this project.

WHAT DOES THAT I-526 APPROVAL MEAN?

EB-5 visa applicants can apply for U.S. residential status once the I-526 petition is complete. They do so by filing the form I-485 adjustment of status 20-22 months after I-526 approval if they are already in the United States as a nonimmigrant, or by filing the DS-230 application if they are abroad.

HOW DID THEY GET THEIR I-526?

I-526 petitions are usually completed by immigration attorneys and submitted to the USCIS. Investors are usually notified as to whether or not the petition has been approved by USCIS after a period as short as a year, but up to 20 months.

 

WHICH EB-5 PROJECT DID THEY GET THEIR APPROVAL THROUGH?

Through Columbia International Finance, our USCIS-approved Regional Center accepting EB-5 visa investment into the Seattle Innovation Center project.

WHAT IS THE STATUS OF THAT EB-5 PROJECT?

Seattle Innovation Center is deep in construction with structural work rising the eight floor above grade. The project remain on target for mid 2020 occupancy and immigrant EB-5 investments and I-526 approvals continue.

IMPORTANT UPDATES:

 

1) The EB-5 community is monitoring possible upcoming changes to the EB-5 and Regional Center programs. The increased investment amount for a TEA-based project, from $500,000 to as much as $1,350,000 is of great concern to potential investors. 

2) With increased interest from non-Chinese investors, processing times are lengthening and investors who act sooner are likely to have their processing times align with the terms of the loan – allowing timely repayment of funds.

 

3) The USCIS has stated that it wants to advance the new regulations by November 2018. Whether that will happen is unclear. Either way, if you are close to committing to an EB-5 investment, it is certainly clear that program rules will change in the coming months. There is a general sense that investors who are accepted by USCIS under the current rules will proceed with those rules. Getting your application together in the coming weeks is wise.
